Terms & Conditions
Introduction
Offering Project Management, Contract Administration and Principal Designer services, KZ Construction Consultancy Ltd. (KZCC) will provide reassurance to Clients that works being carried out are in line with the Contract Documents and best practice. They will administer the Construction Contract, liaise with the Design Team, suppliers and the Client, review Health & Safety aspects with the Principal Contractor, provide guidance where needed and ensure works on site progress at a good pace and delays to the programme of works are kept to a minimum.
Content
Prior to construction works
KZCC can provide, if required, a comprehensive review of the construction documents prior to Tender or commencement of works on site. If nominated to carry out such review, KZCC will liaise with the Client and various consultants in order to ensure that the construction information available to the main contractor is as complete as possible. KZCC will also aim to identify and resolve potential clashes between the designs of different consultants.
While it can be expected that additional information would be required from the Design Team during construction and KZCC cannot guarantee the complete avoidance of clashes between the different design packages, the pre-construction review can prove highly beneficial as a form of checklist, to ensure construction works begin in the best way possible.
In addition, KZCC can assist with the tendering process, sending the Tender documents to potential contractors and meeting them on site if necessary, defining the Tender return deadline, conducting a comprehensive Tender analysis for the Client and sending queries to contractors as necessary, nominating the Main Contractor chosen by the Client and preparing a construction contract for signing between the parties.
If appointed as Principal Designer, KZCC can prepare the Pre-construction information on behalf of the Client and distribute it to the principal Contractor and other designers, to comply with the CDM regulations. The above work will be charged on an hourly basis, in full agreement with the Client and tailored to the size and complexity of each project.
During the construction period
For each project, KZCC will propose a certain number of weekly site visits to be carried out during the entire construction period or a part of it, as agreed with the Client. The visits will be carried out on fixed days and times, unless agreed otherwise. The number of weekly visits may change during the construction period, as requested and agreed in advance with the Client.
During construction, KZCC’s role will consist of:
On completion of construction works
Once practical completion has been achieved, KZCC will issue a certificate to this effect and liaise with the building Control, providing them with all necessary certification to obtain the Certificate of Completion as necessary.
KZCC can assist with the preparation of snagging lists and reviewing rectification works carried out by the Contractor to this effect. If appointed as Principal designer, KZCC will issue the Health & Safety file, as required in the CDM regulations.
Exclusions:
Fee Payment
During the construction period, KZCC’s invoice will be issued on a weekly / monthly basis, as agreed in the confirmation of appointment email. The Client will pay the fee, in accordance with KZCC’s payment terms displayed on the invoice: “within 7 days”, unless specified otherwise by prior agreement.
Absences and cancellations
Should KZCC miss any site visit/s scheduled to be carried out due to sickness, holiday or any other reason, a reduction from their monthly fee will be made in proportion to the number of visits missed. Should KZCC be able to carry out part of their work despite not attending site, a partial deduction may be agreed with the Client, as necessary.
Termination
Both parties will be free to terminate KZCC’s involvement at any stage of the project, by serving a one month’s notice. In any event, fees to be paid in full for the period of KZCC’s involvement.
